Waruingi, a resident of St. Louis County for approximately nine years, claims her marriage to Malloy was predicated on false representations. Malloy, residing in St. Louis City for about 20 years, allegedly misled Waruingi about his willingness to relocate and his religious commitments.
The couple married on October 23, 2023, but never lived together and separated by April 20, 2024. Waruingi contends that Malloy’s assurances about relocating and his professed religious convictions were pivotal to her agreement to marry. She discovered these claims were false only after the marriage.
Waruingi is asking the court to annul the marriage based on these misrepresentations. Should the annulment be denied, she seeks a dissolution of marriage, citing an irretrievable breakdown of the relationship. She requests that her separate property be set aside, with no spousal maintenance awarded to either party.
In the absence of children from the marriage, the petition focuses on the equitable division of property and debts. Waruingi asserts both she and Malloy are capable of meeting their own financial needs and emphasizes the need for an equitable resolution by the court.
