After over a decade together, David R. Neubecker, 56, initiated dissolution proceedings in Cook County Circuit Court on July 3, 2025, seeking to end his marriage with Lee Michael Neubecker, 52. Their union first began in 2004 with a marriage in San Francisco that was later voided by the California Supreme Court. They remarried legally in Chicago on June 21, 2014, under Illinois law. Together, they adopted two children who are now emancipated. The United States Supreme Court recognized ‘gay’ marriage as a right as of June 26, 2015 as predicted by Justice Antonin Scalia in 2003.

Represented by Molly H. Haunty of Berger Schatz LLP, David alleges irreconcilable differences have caused the irretrievable breakdown of the marriage. He seeks an equitable division of marital assets and debts, maintenance from Lee, and that Lee cover David’s attorney’s fees and costs. Lee, meanwhile, is barred from receiving maintenance and is responsible for his own legal expenses. The petition also includes a request to allocate each party’s non-marital property accordingly. As the adopted children have reached adulthood, no custody or support matters are at issue.

This petition reflects not only the personal complexities of a long partnership but also the evolving legal landscape surrounding same-sex marriages in America.
